These Terms & Conditions (“Terms”) apply to your access to and use of www.newbyteas.awe (the “Website”) and to any purchase of products from the Website. The Website is operated by Geralt ME LLC (“Geralt ME”, “we”, “us”, “our”) in the United Arab Emirates.

By browsing the Website, creating an account, placing an order, or otherwise using the Website, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

Eligibility and Account Registration

  • The Website is intended for users aged 18 years and above. If you are under 18, you must not place an order or register an account.
  • If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for any activity under your account.
  • We may suspend or terminate accounts or restrict access where we reasonably believe there has been misuse, fraud, unlawful activity, or breach of these Terms.

Product Information

  • Product images are for presentation purposes. Packaging and visual appearance may vary.
  • Product descriptions, availability and pricing may change. We try to keep information accurate, but errors can occur.
  • Tea is a natural agricultural product and may show subtle variation between batches while remaining within quality standards.

Orders and Contract Formation

  1. Placing items in your basket does not reserve them.
  2. When you submit an order, you are making an offer to purchase.
  3. A contract is formed only when we send you an Order Confirmation (typically by email) and payment has been authorised.
  4. We may decline, suspend or cancel an order in reasonable circumstances including where:
  • Payment authorisation fails
  • Pricing or stock information is incorrect
  • We suspect fraud, misuse, or a breach of these Terms
  • Delivery cannot be completed to the address provided

If we cancel an order after
payment has been taken, we will refund the amount paid in accordance with these
Terms.

Prices, Currency, Vat and Payment

  • Prices are displayed in United Arab Dirhams (AED), unless stated otherwise.
  • All prices are inclusive of Value Added Tax (VAT) at the prevailing rate in the United Arab Emirates.
  • Total order costs, including shipping fees and any administrative charges, will be clearly itemised and displayed for your review at checkout prior to final purchase.
  • For international orders, shipping fees are calculated at checkout; however, please note that the recipient remains responsible for any local import duties or taxes upon delivery
  • We accept payment via the methods shown at checkout. All payment transactions are securely processed by our authorised payment service providers.
  • We do not store full credit or debit card details on our servers.
  • Your bank or card issuer may apply additional charges, such as foreign exchange or processing fees. These charges are outside our control, and remain the sole responsibility of the cardholder.

Refunds: Where a refund is due,
refunds are issued to the original payment method used for the purchase, unless this is not possible or required otherwise by applicable UAE laws and regulations, in which case an alternative method may be used

Promotions, Codes and Gift Benefits

From time to time, we may offer promotions (such as discount codes, gifts with purchase, free shipping thresholds or limited offers). Unless we state otherwise:

  • Promotions are subject to eligibility conditions, including minimum spend, product exclusions, time limits, and one per customer.
  • Promotional codes may not be combined.
  • We reserve the right to refuse, cancel, or reverse promotional benefits in cases of misuse, suspicious activity, or obvious error.
  • If an order benefiting from a promotion is returned or refunded, any refund will reflect the amount actually paid after the promotion was applied.
  • Where a free gift is provided and the qualifying purchase is returned, we may require the gift to be returned unused or deduct its value from the refund, where permitted by law and clearly communicated.

Shipping, Delivery and Collection

7.1 UAE Delivery

  • Delivery timeframes displayed on the Website are estimates only and may vary due to address access, courier operations, or external factors beyond our control.
  • You are responsible for providing accurate delivery details and ensuring availability to receive the order, where required.

7.2 Risk and Title

  • Risk of loss or damage passes to you upon delivery to the address provided, or upon collection where applicable.
  • Ownership/title to the goods passes to you once full payment has been received, subject to any mandatory legal rights.

7.3 Split Shipments

  • Items may be shipped separately where operationally necessary, for example where products are stored in different locations. We will aim to notify you where this occurs.
  • If multiple shipments occur, your card statement may show more than one transaction entry, depending on payment processing.

7.4 Self-Collection

  • Self-collection is available for orders placed directly via email at e boutique@newbyteas.ae or via WhatsApp or phone on 055 600 3695.
  • Order preparation time is typically 24 to 48 hours, depending on product availability.
  • Payment must be completed in advance via a secure payment link.
  • Collection is from Newby Teas offices, Business Bay, Dubai, United Arab Emirates.



7.5 International Delivery

International delivery is available only to selected destinations listed on our Website and may be withdrawn or restricted at any time.

Where international delivery is offered:

  • Delivery timeframes are estimates only and may be affected by customs clearance and local authority processes.
  • You are responsible for any import duties, taxes, handling fees, or local restrictions, unless we expressly state otherwise.
  • We reserve the right to refuse or cancel international orders where delivery is restricted by sanctions, export controls, local laws, or courier limitations.
  • We are not responsible for delays, seizures, or refusals by customs authorities arising from destination-specific regulations or documentation requirements outside our control.

Cancellation, Returns and Refund

Cancellations, returns, and refunds are governed by our Cancellation, Refund & Return Policy, which forms part of these Terms & Conditions and applies alongside applicable UAE consumer protection laws.

8.1 Order Cancellations

  • Requests to cancel an order must be made promptly after placing the order.
  • We will make reasonable efforts to cancel orders prior to dispatch; however, cancellation cannot be guaranteed once order processing has begun.
  • ·Once an order has been dispatched, it cannot be cancelled and will instead be handled in accordance with our returns process.

8.2 Returns After Delivery 

  • Returns are accepted only for eligible items and within the timeframes specified in our Cancellation, Refund & Return Policy.
  • All return requests are subject to review and approval, and items returned without prior authorisation may be refused. 

8.3 Non-Returnable Items

  • Unless required by applicable UAE law, returns are not accepted for:
  •  Opened or used tea products or items where hygiene or quality would be affected.
  • Perishable goods
  • Items damaged due to improper handling or storage after delivery.
  • Items not returned in original condition or packaging.
  • Items returned outside the applicable timeframes.

8.4 Damaged, Defective or Incorrect Items

  • If your order arrives damaged, defective, incorrect, or incomplete:
  • You must notify us within the timeframes set out in our Cancellation, Refund & Return Policy.
  • You may be required to provide your order number and supporting photographs.
  • Where verified, we may offer a replacement, refund, or other appropriate resolution, depending on the circumstances and stock availability.

8.5 Refund Processing 

  • Approved refunds are issued to the original payment method used for the purchase, in accordance with applicable UAE laws and regulations.
  • Refund processing times vary depending on the payment provider and your bank or card issuer.

Website Use And Acceptable Conduct

You agree not to: 

  • Use the Website for unlawful purposes.
  • Interfere with the operation or security of the Website.

  • Our total liability arising out of or in connection with any order, product, or use of the Website shall be limited to the total amount paid by you for the relevant
    order.
  • We are not responsible for any loss, damage, or disruption arising from the use of, or reliance on, third-party websites, services, or content accessed via links on the Website, nor for any interruption, delay, error, or unavailability of the Website.

Events Outside Our Control

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including courier disruptions, strikes, extreme weather, government action, system outages, or similar events. Sanctions And restricted Destinations

Governing Law and Jurisdiction
